It\u2019s an honor, Goldberg\nnotes, and something to which he strives daily to remain worthy of such a\ngesture. That certainly ranks above having a bronze statue sitting on a dusty\nshelf somewhere, commemorating his legacy in past terms.<\/p>\n\n\n\n<p>\u201cMore importantly,\u201d observed Goldberg, a 2020 <em>ENX Magazine<\/em> Difference Maker, \u201cI did\nnot have to die to receive the honor.\u201d<\/p>\n\n\n\n<p>It\u2019s true that there is simply much more of Goldberg\u2019s story\nleft to be told. It\u2019s been 43 years since he first provided antitrust guidance\nfor the then-National Office Machine Dealers Association (NOMDA) to ensure\nlegal compliance. In those early years of the relationship with what is now BTA,\ndealers sought to level the playing field in terms of their bargaining position\nwith suppliers. Product performance issues were a frequent concern and\ndealer\/supplier agreements generally favored the latter. <\/p>\n\n\n\n<p>NOMDA created the Model Dealer Agreement, which became an\nindustry standard, and dealers now routine exceed the annual revenue of their\nsuppliers. And Goldberg has enabled the BTA dealer community to resolve\nsupplier disputes without the need for litigation. Suffice to say, the BTA\ndealer is now in a much better positioned to reconcile issues. <\/p>\n\n\n\n<p>\u201cThe NOMDA\/BTA\nLegal Hotline has provided members with legal assistance from a knowledgeable\nindustry participant,\u201d Goldberg noted. \u201cNOMDA also established a legal defense fund,\nwhich assisted members with litigation costs in disputes that could not be\nresolved in a business context. NOMDA introduced in Congress the Fair\nDealership Practices Act, resulting in an industry-wide agreement as to\ncontractual terms and practices to be followed.\u201d<\/p>\n\n\n\n<p>As industry\nplayers go, fewer are more recognizable than Goldberg, of counsel with the\nChicago-based firm Schoenberg, Finkel, Beederman, Bell, Glazer LLC. He\u2019s been\ndispensing legal counsel to BTA dealers on the subject of employment\nissues, documentation, legislative matters, sales tax, fraudulent\ntelemarketing, business valuation or other relevant subjects for nearly five decades. Chances are, if you\nattend BTA-hosted events, you\u2019ve heard one of Goldberg\u2019s countless\npresentations on the day\u2019s most pressing topics.<\/p>\n\n\n\n<p>Goldberg owes a\ngreat deal to the late A. Gordon Adams for his introduction to the industry\u2019s\nmovers and shakers. The bankruptcy court had sought to\nrecover all payments made by the leasing company in the 90 days prior to\ndeclaration, an action that sought a refund of all leases funded during that\ntime. <\/p>\n\n\n\n<p>The impacted\ndealers, who had already provided equipment to their end-users, were confronted\nwith the possibility of losing payment and endangering their status as an\nongoing concern. Fortunately, Goldberg and the BTA were successful in garnering\nthe repayment of funds in bankruptcy court\u2014pulling the dealers out of dire\nstraits.<\/p>\n\n\n\n<p>Even as Goldberg\napproaches retirement, he seeks to continue his work with the BTA and its\nmembers \u201cfor as long as I can continue to do so in a competent and professional\nmanner.\u201d It\u2019s been his life\u2019s work, and he hopes to continue guiding members as\nthey navigate through the pandemic.<\/p>\n\n\n\n<p>\u201cThe coronavirus\nhas greatly changed the industry and I hope to assist in successfully moving\ninto the next stage,\u201d he said.<\/p>\n\n\n\n<p>Next month, Bob\nand Carol Goldberg will celebrate their 50<sup>th<\/sup> wedding anniversary.\nThe Goldbergs enjoy vacationing in Punta Mita, Mexico.
